Ausgehend von der gewachsenen politischen Bedeutung des Bundesverfassungsgerichts seit seiner Gründung im Jahre 1951 untersucht die Arbeit die verfassungsrechtlichen Grenzen des Gerichts. Dabei wird die entscheidende Rolle der Normbindung für die Entscheidungskompetenz des Gerichts deutlich. Eine hinreichende Normbindung kann nur durch eine Interpretationsmethode erreicht werden, die den Willen des Normgebers ernst nimmt. Eine stärkere Fokussierung auf den Willen des Verfassungsgebers ist methodisch möglich. Die Entwicklungspotentiale der Verfassung bleiben dabei gewahrt. Die Arbeit zeigt am Beispiel des Ehebegriffs in Art. 6 Abs. 1 GG, wie eine solche verfassungskonforme Interpretationsmethode in der Praxis Bestand haben kann.
