    • Constitutional law can appear differently in political crises or national and international conflicts. Lawyers from Africa, Asia, Europe and South America examine in national or comparative perspectives current constitutional legal problems. The scope of the contributions encompasses:°°- the anti-terrorist struggle in Belgium and France°°- constitutional emergencies in France, Austria and Poland°°- constitutional problems of the Russian-Ukrainian conflict°°- constitution-changing majorities in Brazil°°- ill-gotten political party assets in Taiwan°°- violent clashes between herdsmen and indigenous ethnic communities across West Africa °°- constitutional processes in sub-Saharan Africa°°The topics were originally discussed at the 10th World Congress of Constitutional Law (IACL-AIDC), held from 18–22 June 2018 at Sungkyunkwan University in Seoul, Korea, on Violent Conflicts, Peace-Building, and Constitutional Law.

    • Eine unabhängige und funktionsfähige Justiz ist eine unverzichtbare Voraussetzung für einen demokratischen Rechtsstaat und eine stabile wirtschaftliche Entwicklung. In den beiden größten Ländern im postsowjetischen Raum, in Russland und der Ukraine, ist es ein weiter Weg hin zu einer unabhängigen Justiz, gerade wenn man die gerichtliche Kontrolle des Präsidenten und der Regierung in den Blick nimmt. Aber auch in Ungarn und Polen, Mitglieder der Europäischen Union seit 2004, ist die Verfassungsjustiz auf Grund zunehmenden politischen Drucks in ihrer Unabhängigkeit bedroht. Juristen aus diesen Ländern sowie aus Deutschland und aus Israel untersuchen unterschiedliche Fragen des Zustands und der Entwicklung der Justiz, primär in den Ländern Russland, Ukraine, Polen und Ungarn. Ein Schwerpunkt ist die Rechtsentwicklung in Russland, vor allem die sehr umstrittene Abschaffung des russischen Obersten Arbitragegerichts und die Übertragung seiner Funktionen auf das Oberste Gericht.

    • Public-Private Partnership models are often controversially discussed with regard to not only their benefits and advantages, but also the chances and risks inherent in their realisation. However, there is no doubt that in developing countries the involvement of private investment and private partner can contribute to economic growth and the expansion of infrastructure. In Tunisia, the government is actively supporting PPP projects, believing that they are crucial for the further development of the country’s economy and the welfare of the people. The contributions in this book are the result of the cooperation between Tunisian and German scholars and reflect general as well as country-specific current and future frameworks of PPP and best practices of both countries. A comparison of Tunisia’s concession-based concept with the infrastructure- and construction-focused approach in Germany leads to the conclusion that an open framework for PPP is desirable. The volume provides not only scholars, but also policymakers in Maghreb countries and development and investment protagonists with an overview of the PPP sector’s current development in Tunisia and Germany.

    • Even though Germany and Poland are neighbours that are bound together by a joint European tradition and have much in common in their public law systems, they may fundamentally differ on certain legal issues. In comparative law, diversity is not a term of abuse. For many years, there has been a lively debate in Polish-German comparative law, above all in the field of administrative law. This book presents a selection of papers dealing with topics in administrative law and administrative sciences. These papers were presented by scholars and doctoral students from Poland and Germany at a bilateral symposium under the headline “Administrative Traditions in Poland and Germany: Similarities and Differences”, which took place at the Berlin School of Economics and Law.

    • Neither security nor risks are issues that can be appropriately considered or examined from within the narrow confines of a single country; crime does not stop at the national borders. The demand for security services has steadily increased both throughout Europe and the world. The above mentioned scenarios soon gave rise to the idea of creating an academic training programme in Security Management with a strong international focus. This book describes the development of a respective project and its implementation in higher education. The core of the book is devoted to the academic contributions that were most influential on the initial implementation of the project. Most of these contributions are given by scholars who are teaching the Programme at the Berlin School of Economics and Law.
