The maritime distress of migrants and anthropogenic climate change are among the most pressing humanitarian and political challenges today. This paper explores whether the failure of states and supranational entities to address these issues constitutes extreme injustice from a legal ethical standpoint, referencing the Radbruch formula. It examines the minimum ethical obligations this situation imposes on states and communities of states. The author advocates for the development and application of relevant analyses and discourses as normative guidance. This approach emphasizes the need for applied legal philosophy not only in the context of migration and climate protection policies but also for lawmakers and public discourse. By framing these complex problems through a legal ethical lens, the paper seeks to illuminate the responsibilities of states in addressing the crises faced by migrants and the environment, urging a proactive stance in both legal and moral dimensions.

In Bezug auf das komplexe methodische Verhältnis zwischen Rechtsbindung und prognostischer Entscheidung bei der Wahrnehmung psychosozial ausgerichteter Aufgaben herrscht nicht erst in jüngster Zeit methodischer Klärungsbedarf. Was kann von psychosozial orientierten Gesetzen in funktionaler Hinsicht konkret erwartet werden, soweit es innerhalb des jeweiligen Anwendungsbereiches in einschlägigen Fällen um die Ausgestaltung von Hilfen bzw. Interventionen geht? Und wie lässt sich die entsprechende gesetzliche Funktion in Bezug auf fachliche Entscheidungen rechtsmethodisch aufgreifen und realisieren – auch und gerade mit Rücksicht auf ggf. inhaltlich und zeitlich abzugrenzende sozialpädagogische Handlungsschritte? Auf Basis der neueren Fachdiskussion der Jahre 2010-2017 zeigt die vorliegende Arbeit methodische, empirische, und wissenschaftstheoretische Perspektiven im Bereich dieses wichtigen, interdisziplinär geprägten Themenfeldes auf. Das abschließende Plädoyer lautet, psychosozial orientiertes materielles Recht systematisch und inhaltlich nicht als Quelle der Determinierung und Feinsteuerung, sondern primär als finales, qualitätssicherndes Instrument innerhalb von Hilfe- und Interventionsprozessen zu begreifen und zu nutzen. Dieser Ansatz mündet in Grundlinien einer anwendungsbezogenen interdisziplinären Entscheidungstheorie.
